Privacy Policy Statement

This is the Ovitoz (Pty) Ltd Privacy Policy Statement. It explains how we collect, use, protect and share your Personal Information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and other applicable data protection legislation.

Ovitoz (Pty) Ltd ("Ovitoz", "we", "our", "us") is committed to protecting your privacy and processing your Personal Information lawfully, transparently and securely in accordance with the Protection of Personal Information Act, 2013 (POPIA) and other applicable data protection legislation.

About the platform

As a digital rewards ecosystem, Ovitoz allows members to earn, redeem and manage rewards while using digital wellness, lifestyle, shopping, and partner services.

What this policy covers

This Privacy Policy explains who we are, what information we collect, how we use it, who we share it with, how long we retain it, how we protect it and the rights available to you.

When this policy applies

This Privacy Policy forms part of the Ovitoz operational Terms and Conditions and applies whenever you:

  • register for an Ovitoz account;
  • join the Ovitoz Rewards Programme;
  • use our website or mobile application;
  • interact with our WhatsApp support or chatbot;
  • link wearable devices;
  • upload photographs or body measurements;
  • connect third-party accounts;
  • interact with participating rewards partners; and/or
  • elect to opt in through any of our platforms, social media accounts or Messenger sites.

Who We Are

Ovitoz (Pty) Ltd is the Responsible Party for purposes of POPIA in respect of data handling. Our principal business is operating a digital rewards and engagement platform that connects members with participating merchants (Brand Partners).

Scope of Application

This Policy applies to customers, prospective customers, B2B merchants (rewards partners), visitors to the Ovitoz Platform, users of Ovitoz mobile applications, chatbot users and WhatsApp customer support interactions.

Your Rights as a Data Subject

You have the right to:

  • access your Personal Information;
  • correct inaccurate information;
  • request deletion;
  • object to processing;
  • withdraw consent where consent is the legal basis;
  • restrict processing;
  • request details of recipients;
  • lodge complaints with the Information Regulator.

Ovitoz will verify your identity before processing any request and respond within applicable statutory timeframes, following a documented request process similar to that contemplated by PAIA and POPIA.

What Personal Information We Collect

In the first instance, Ovitoz may collect information directly from you. Where we are unable to collect sufficient data directly from you, we may rely on data from other sources linked, associated with or otherwise affiliated with our Programme. Direct data capturing will be through your use of the Platform, from connected devices, participating partners and authorised third parties. Some of the personal information we collect may be sensitive in nature. This is known as special personal information and includes information about your health, biometrics, race and any alleged criminal or objectionable behaviour.

How We Use Your Personal Information

  • Health data is used solely for calculating reward token (OVI/Vitos) allocation and verifying movement plausibility.
  • Ovitoz does not sell, license, or monetise raw health data to third-party medical aids, insurers, or data brokers.
  • Ovitoz processes information solely to personalise rewards, generate clothing recommendations, improve AI recommendations, recommend products, recommend participating merchants, personalise wellness journeys, improve member experiences.
  • Biometric information is not sold, is encrypted, is accessible only to authorised personnel, and is retained only for as long as necessary.
  • Ovitoz uses artificial intelligence technologies to provide personalised recommendations, reward optimization, wellness insights, merchant recommendations, chatbot responses, predictive analytics and personalised promotions. AI recommendations are intended to assist members and should not be regarded as medical, healthcare or professional advice.

Health Telemetry — Background Synchronisation

  • Where you enable background synchronisation, you expressly authorise Ovitoz to periodically access and synchronise your health information from authorised devices and connected health platforms without requiring you to manually upload the information each time.
  • Synchronisation may occur automatically while the application is installed; frequency may vary depending on your device settings.
  • Synchronisation may continue until you revoke the relevant permissions or disable the feature.
  • You may disable synchronisation at any time through either device permissions and/or Ovitoz application settings.
  • Background location tracking only occurs where expressly authorised; permission may be withdrawn at any time.
  • Operators are contractually required to maintain confidentiality, implement appropriate security, process information only on our instructions, and comply with applicable privacy legislation.

Cookie and Tracking Technologies

Ovitoz uses cookies, software development kits (SDKs), pixels and similar technologies on its web and digital platforms. These technologies are classified according to their function and are subject to the consent requirements set out below.

Strictly necessary cookies

Used for functions that are required to operate, secure and deliver the Platform, including authentication, session management, security and fraud prevention. Where such cookies are technically necessary to provide a service requested by you, they may operate without optional tracking consent. They are not used for third-party behavioural advertising.

Functional and preference cookies

Remember settings, preferences and login-related choices to improve the operation and usability of the Platform. Where these technologies are not strictly necessary, they will only be activated in accordance with your cookie preferences.

Analytics cookies

Measure how users interact with the Platform and help Ovitoz understand and improve performance. Where analytics technologies transmit Personal Information or online identifiers to a third party, they will not be activated until the required prior consent has been obtained.

Marketing and advertising cookies

Pixels and similar tracking technologies are used to measure campaign performance, attribute conversions and, where applicable, support audience or advertising functions. These technologies are optional and are disabled by default until you provide explicit, affirmative consent.

Meta Pixel and related Meta technologies

Ovitoz may use the Meta Pixel and related cookies or technologies supplied by Meta Platforms, Inc. and/or its relevant affiliates ("Meta"). Where enabled, these technologies may process information such as cookie identifiers, device and browser information, IP address, pages or events viewed, interactions with Ovitoz advertisements or webpages, and conversion events. Ovitoz uses this tracking principally to measure and attribute conversions for its B2C waitlist engine, evaluate campaign effectiveness and understand whether advertising results in relevant Platform actions.

Cookie and Tracking Consent Banner

When you first visit the Ovitoz web Platform, and where renewed consent is required, Ovitoz will display a prominent consent banner before any non-essential marketing or third-party tracking technology is activated. The banner operates as a technical gatekeeper: non-essential tracking scripts and cookies, including the Meta Pixel, remain blocked unless and until you make an affirmative choice to accept the relevant category of tracking. Consent will not be inferred from silence, continued browsing, pre-ticked boxes or inactivity. Rejecting optional tracking will not prevent access to the core functionality of the Platform. You may withdraw or change your consent at any time through the cookie preference centre or equivalent privacy controls.

Ovitoz processes information to:

  • administer memberships;
  • operate its rewards Programme;
  • issue rewards;
  • process redemptions;
  • personalise member experiences;
  • authenticate users;
  • provide customer support;
  • manage competitions;
  • detect fraud;
  • comply with legal obligations;
  • improve Platform performance;
  • perform analytics;
  • develop new services.

Data Sharing

Personal Information may be shared with:

  • participating rewards partners;
  • fitness partners;
  • payment processors;
  • cloud providers;
  • analytics providers;
  • AI providers;
  • regulators;
  • law enforcement;
  • auditors;
  • legal advisers.

Where information is shared with service providers, contractual safeguards are implemented to ensure appropriate protection and use only for authorised purposes. Ovitoz does not sell your Personal Information.

Cross-Border Transfers

While Ovitoz itself does not process Personal Information outside of South Africa, certain Operators such as Brand Partners may do so. Where this occurs, Ovitoz will ensure that adequate contractual or statutory safeguards protect your Personal Information, consistent with POPIA requirements.

Third-Party Marketing and Attribution Processing

Subject to your prior consent, Ovitoz may disclose or make available limited Personal Information, online identifiers and event information to third-party technology providers for marketing measurement, campaign attribution and related advertising purposes. Third-party technology providers may include Meta in connection with the Meta Pixel and related technologies. Ovitoz will not activate third-party marketing or attribution processing merely because a user visits the Platform. Such processing is conditional upon the user's prior affirmative consent where consent is required.

How We Protect Your Personal Information

Security

Ovitoz maintains industry-standard safeguards including secure APIs, access controls, penetration testing, vulnerability management, audit logging and monitoring.

Retention

Personal Information is retained only while your account remains active, for legal compliance, for contractual purposes, to resolve disputes and for legitimate business purposes. Information is securely deleted or anonymised when no longer required.

Data Breach Response

Where a security compromise occurs, Ovitoz will investigate the incident and contain the breach while assessing the affected information. Affected users will be notified where a breach is material or notification is otherwise required. Where material or otherwise required, the Information Regulator will be notified where legally required. Corrective measures will be implemented and internal controls reviewed.

Children's Privacy and Personal Information of Children

Ovitoz does not knowingly collect Personal Information from children without the consent of a parent or legal guardian where required by law. Use of Ovitoz is directed at major persons who would be ordinary purchasers of goods and/or services from our brand ambassadors.

PAIA Manual

Ovitoz maintains a PAIA Manual in accordance with section 51 of PAIA. The PAIA Manual contains categories of records, Information Officer details, request procedures, applicable forms, fees, objection procedures, deletion request procedures. The Manual is available upon request and through the Ovitoz website, reflecting the statutory requirements for private bodies under PAIA and POPIA.

Changes to this Privacy Policy Statement

Ovitoz may amend this Policy from time to time to reflect legal, operational or technological changes. Updated versions will be published on the Platform and, where appropriate, notified to members.

Information Officer Contact Details

Ovitoz has appointed an Information Officer responsible for POPIA compliance. Responsibilities include ensuring compliance with POPIA, maintaining processing records, responding to data subject requests, reporting security compromises, maintaining staff awareness and liaising with the Information Regulator.
